Tully RX

Terms of Service

Last updated: [DATE — set at counsel sign-off]

The plain-language agreement between you and Tully RX for using this site and the telehealth services offered through it.

01Agreement to these terms

These terms govern your use of the Tully RX website, patient portal, and the telehealth services offered through them. By creating an account, completing a health assessment, or placing an order, you agree to these terms.

If you do not agree, please do not use the service. Counsel to confirm: governing entity name, contracting parties, and age/capacity requirements.

02What the service is (and isn't)

Tully RX provides access to telehealth consultations with independent licensed healthcare providers, and — where a provider issues a prescription — fulfillment through licensed partner pharmacies.

  • Whether treatment is appropriate for you is always decided by a licensed provider, not by this website.
  • Completing an assessment does not guarantee that treatment will be prescribed.
  • The service is not for emergencies. If you are experiencing a medical emergency, call 911.

Counsel to confirm: corporate-practice-of-medicine structure and how the provider relationship is described.

03Eligibility and your account

You must be an adult located in a state where the service is available, provide accurate and complete health information, and keep your account credentials secure.

Providing false or incomplete health information can lead to unsafe care and is grounds for declining or ending service.

04Payment and billing

When you check out, a temporary authorization hold is placed on your payment method. You are charged only if and when a licensed provider approves your treatment. If the provider cannot approve, the hold is released.

Ongoing treatment plans renew on a recurring cycle (typically every 28 days) until you cancel. You can manage or cancel your plan from your account at any time.

Counsel to confirm: subscription disclosure language per state auto-renewal statutes, and refund terms cross-referenced to the Refund Policy.

05Acceptable use

You agree not to misuse the service — including impersonating another person, completing an assessment on someone else's behalf, reselling or sharing prescribed medication, or attempting to access another patient's information.

06Intellectual property

The content, branding, and software behind this service belong to Tully RX or its licensors. You may use the service for your personal, non-commercial care only.

07Disclaimers and limitation of liability

Placeholder: standard warranty disclaimer and limitation-of-liability clauses to be drafted by counsel, including any carve-outs required for healthcare services and state consumer-protection law.

08Disputes and governing law

Placeholder: dispute-resolution approach (arbitration vs. courts), class-action waiver decision, governing law, and venue — all to be determined by counsel.

09Changes to these terms

We may update these terms from time to time. We will post the updated version here with a new “Last updated” date, and where changes are material we will notify you before they take effect.
